HitStudio Terms of Service
What the software does, what it refuses, what it costs.
Version of October 30, 2026. You accept them when you create your account, which records the date.
These Terms of Service govern the use of HitStudio, called Studio below, available at gethitstudio.com and studio.appelia.cloud.
1. Purpose
Studio is software that writes, builds, checks, posts on instruction and measures video and image ads for a brand, based on the file the brand describes. The contract covers access to the software, not a commercial result. The publisher is identified in the legal notice.
2. The account and the trial
An account is created with an email address and a password. The trial includes 40 credits once, with no credit card, within a shared allowance set by the publisher. The account owner is responsible for what is done with it.
3. Credits
Each creation uses a public number of credits, which Studio shows before each build and which the brand accepts before it starts. The price list, in credits:
Credits are charged on success only: a refused or failed creation costs nothing. A plan’s credits are added every month on the anniversary date of the subscription, and roll over while the subscription runs; an unpaid month adds none. After the subscription ends, remaining monthly credits can be used for 90 days, then expire.
An active paid subscription allows the purchase of credit packs, as a one-time purchase with no renewal: 100 credits for $39, 200 credits for $75, 500 credits for $179, 1,000 credits for $329. A pack changes neither the plan nor its billing date, and unlocks no feature. Monthly credits are used first, then pack credits, oldest first. Pack credits do not expire, including after the subscription ends: they can then be used for the creations open on the Free trial. The Free trial does not allow buying packs.
4. Plans and price
Plans, prices, automatic renewal and cancelling in two clicks: Subscription and cancellation. Withdrawal and refunds (14 days, pro rata): Right of withdrawal, Refunds.
5. What the software refuses
A creation that would break the law or the ad platforms’ rules (fake testimonial, health claim, guaranteed result, missing label on generated content) is refused before it is built, with the rule that requires it. This check is an aid, not a guarantee: the brand alone remains responsible for the ads it runs and for their compliance with each platform’s rules.
Using Studio to create fake reviews or fake testimonials is prohibited. The brand discloses to its audience that its videos are AI-generated.
6. Generated content
A video generated by artificial intelligence always carries the visible “AI-generated video” mention and, in the file’s metadata, the machine-readable label of Article 50 of the European regulation on artificial intelligence: neither can be removed. A video edited from the brand’s own footage carries the mention at the brand’s choice. No generated person gives a testimonial or presents themselves as a customer.
7. Posting and measurement
- Nothing is posted without an explicit instruction from the brand.
- View measurement covers YouTube, TikTok and soon Instagram, for the accounts the brand connects; sales measurement requires an ad platform connected by the brand.
- No audience and no result is promised:
- no promise of going viral: we measure, we don’t predict
- no guaranteed results in 30 days: the verdict needs 6 measured videos PER APPROACH, so 12 with two approaches and 24 with four
- and it compares without promising a winner: with enough volume, “no approach stands out” is a possible result
- for sales it needs more: 10 purchases per approach, otherwise one more purchase could change the ranking
- no made-up reviews or fake testimonials, ever
- The software writes to the account owner to report on the state of the workspace (a weekly summary, a video to review, a verdict, low credits); these messages can be turned off from the account and through the link in each of them.
8. Ownership
Creations built for the brand belong to it as soon as they are built. The brand warrants that it holds the rights to the visuals, texts and trademarks it provides.
9. Data
Data processing is described in the privacy policy. The brand can export and delete its account from the settings.
10. Liability
The software is provided as is, with the limits stated in the product. The publisher’s liability is limited to the amount paid over the last twelve months. It covers neither the closure of an ad account by a platform, nor a loss of revenue.
11. Termination and governing law
Either party may end the contract at any time. The publisher may close an account that breaches these terms, saying so. French law applies, without depriving a consumer of the mandatory rules of their state or country of residence.
Complaints and mediator: see this page. That page and those listed in section 4 form part of these terms.
12. Legal guarantee of conformity
A consumer customer benefits from the legal guarantee of conformity of digital content and digital services (articles L224-25-1 et seq. of the French Consumer Code): Studio must conform to the contract, including its functionality and compatibility, and the publisher supplies the updates needed to keep it conforming throughout the contract. If it does not conform, the customer first asks for it to be brought into conformity; if that is impossible or takes too long, they may ask for a price reduction or for the contract to be terminated, under the conditions set by law. The limits in section 10 do not stand in the way.
The software is used from a recent browser with an Internet connection; social networks are connected with the brand’s own accounts. A creation you do not like is not a lack of conformity: it can be redone from the product, and a failed creation costs no credits (section 3).
13. Changes to these terms
The publisher may change these terms. Each version is dated (see the top of this page). Any change is announced by email to the account owner at least 30 days before it takes effect, except a change the law requires at an earlier date.
A customer who does not accept the new version may cancel before it takes effect, from Account > Subscription, at no cost: the subscription runs to the end of the paid period (see the Subscription and cancellation page), and the version they had accepted keeps applying to it. Continuing to use Studio after the effective date means accepting the new version.
